1. General provisions
The SWISS Sponsored Travel Voucher (hereinafter referred to as the “Voucher”) is a travel voucher made available by Swiss International Air Lines AG, Obstgartenstrasse 25, 8302 Kloten, Switzerland (hereinafter referred to as “SWISS”).
The Voucher is issued free of charge by SWISS as part of marketing campaigns, prize draws, or other promotional activities.
These Terms of Use govern the use and redemption of the Voucher by the respective user. If the Voucher is issued as part of a prize draw, the corresponding participation terms and conditions shall also apply. Where such terms and conditions, or any other conditions communicated at the time of issuance of the Voucher, contain specific provisions, those provisions shall prevail over these Terms of Use. This applies in particular to provisions regarding eligibility, prizes, redemption, transferability or validity of the Voucher.
In addition to these Terms of Use, SWISS's General Conditions of Carriage and the fare conditions displayed during the booking process shall apply.
2. Issue of the Voucher
The Voucher is issued in the form of a voucher code.
The person who has lawfully received the voucher code is entitled to redeem the Voucher.
The Voucher is not sold but is provided free of charge by SWISS, in particular as a prize in a prize draw or as part of a marketing campaign.
The user must keep the voucher code secure and protect it against unauthorized access by third parties.
Users are solely responsible for the accuracy and completeness of the information provided in connection with the issuance and use of the Voucher, in particular their contact details.
3. Redemption of the Voucher
Unless otherwise specified in the applicable participation terms and conditions, on the Voucher or during the booking process, the Voucher may only be redeemed for bookings made via swiss.com.
The Voucher must be redeemed during the booking process; retrospective application is not possible.
The Voucher may only be redeemed in the currency in which it was issued. For example, if the Voucher is issued in Swiss francs, or if the applicable participation terms and conditions or the Voucher itself provide that redemption is limited to Swiss francs, the Voucher may only be used for bookings charged in Swiss francs.
Up to three Vouchers may be redeemed per booking.
If the value of the Voucher is insufficient to cover the full booking amount, the remaining balance may be paid using one of the payment methods accepted during the booking process.
4. Validity and expiry
Unless otherwise stated on the Voucher or in the applicable participation terms and conditions, the Voucher shall remain valid for twelve months from the date of issue.
The Voucher must be redeemed within its validity period as part of a booking. The relevant date shall be the date on which the booking is completed on swiss.com, unless otherwise stated on the Voucher or in the applicable participation terms and conditions.
5. Permitted use
The Voucher may only be used for eligible bookings made via swiss.com.
Unless otherwise specified on the Voucher or in the applicable participation terms and conditions, eligible bookings are limited to flights operated by SWISS and/or wet lease flights marketed under a SWISS flight number.
Codeshare flights, including flights operated by Edelweiss or other Lufthansa Group airlines, charter flights and AirTrain connections in Switzerland carrying a SWISS flight number are excluded.
Additional restrictions, particularly with regard to departure point, destination area, route, travel period, booking channel, booking currency or other redemption requirements, may arise from the Voucher or the applicable participation terms and conditions. Where the applicable participation terms and conditions provide for redemption only on specific destinations or routes, the Voucher may only be used within those specific redemption restrictions.
6. Remaining balance
If the value of the Voucher exceeds the booking price, the remaining balance shall remain available until expiry of the Voucher. It may be used for additional bookings permitted under these Terms of Use and, where applicable, under the relevant participation terms and conditions.
Any remaining balance shall expire upon expiry of the Voucher. Cash payment, payment of interest, payment in any other form or any other reimbursement of the remaining balance is excluded, without prejudice to any mandatory statutory rights.
7. Transferability and sale
Unless otherwise specified on the Voucher or in the applicable participation terms and conditions, the Voucher is not issued in the name of a specific individual. Accordingly, the holder of the voucher code does not need to be the passenger travelling under the relevant booking.
Where the applicable participation terms and conditions exclude the transfer of a prize to third parties, such exclusion shall remain unaffected.
Use of the Voucher for a booking benefiting another traveller is permitted only insofar as the Voucher and the applicable participation terms and conditions do not prohibit such use.
The sale of the Voucher is prohibited.
Any commercial transfer, resale or other abusive use of the Voucher is not permitted.
8. Refunds
If flight tickets paid for wholly or partially with a Voucher are cancelled and submitted for refund in accordance with applicable legal or fare conditions, the refundable amount paid with the Voucher shall be credited back to the Voucher.
The value of the Voucher cannot be paid out in cash. Payment of interest, payment in any other form, exchange or any other reimbursement of the Voucher is excluded, without prejudice to mandatory statutory rights, in particular statutory refund rights and passenger rights.
9. Protection against misuse
As the Voucher is not personalised, unless otherwise specified on the Voucher or in the applicable participation terms and conditions, knowledge of the voucher code is generally sufficient for redemption.
SWISS shall not be liable for damage resulting from bookings made by an unauthorized third party using the correct voucher code, provided that SWISS is not responsible for the misuse. Clause 10 shall remain unaffected.
No replacement Voucher shall be issued if the voucher code is lost, disclosed incorrectly or redeemed by an unauthorized third party, unless SWISS is responsible for the circumstances giving rise to such loss or misuse. Mandatory statutory rights shall remain unaffected.
10. Liability
SWISS shall have unlimited liability in cases of wilful misconduct or gross negligence, in the event of injury to life, body or health, and in all other cases where liability is mandatory under applicable law.
In the event of a slightly negligent breach of essential contractual obligations, SWISS's liability shall be limited to the foreseeable loss or damage typically arising under the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper use and redemption of the Voucher and upon whose fulfilment users may regularly rely.
In all other cases, SWISS's liability for damage caused by slight negligence shall be excluded.
The above limitations of liability shall apply accordingly for the benefit of SWISS's legal representatives, employees and agents.
11. Data protection
Information regarding the processing of personal data by SWISS in connection with the issuance, use and redemption of the Voucher is available in SWISS's Privacy Notice.
Where the Voucher is issued as part of a prize draw, the privacy information set out in the applicable participation terms and conditions shall apply in addition.
12. Final provisions
Should any provision of these Terms of Use be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
These Terms of Use and the legal relationship between users and SWISS shall be governed by Swiss law. Mandatory consumer protection provisions of the country in which the user has their habitual residence shall remain unaffected.
