Terms and conditions of use for the Compensation Voucher

1. General

The SWISS Compensation Voucher (referred to below as “Compensation Voucher”) is an offer of Swiss International Air Lines AG, Malzgasse 15, CH-4052 Basel (referred to below as “SWISS”). The Compensation Voucher is offered in conjunction with Regulation (EC) No. 261/2004 and the rights of passengers in the event of delay or the Montreal Convention for the carriage of baggage. 

Those who take advantage of this offer (referred to below as “Users”) have the option of using the amount of the voucher to book a scheduled SWISS service (not open-jaw) at a later date, as well as selected additional services on SWISS.com. 

These terms and conditions of use apply to the use of the Compensation Voucher. In addition to these terms and conditions of use, the SWISS General Terms and Conditions of Carriage also apply at all times. 

2. Receiving the Compensation Voucher

SWISS Feedback Management is responsible for issuing the Compensation Vouchers.  The Compensation Voucher is made available in the form of a redeemable code. 

3. Conditions for the use of Compensation Voucher

The redemption of the Compensation Voucher is possible only online at www.swiss.com

Up to three vouchers can be used for one booking.

Unless indicated otherwise on the voucher, the Compensation Voucher is valid from the moment it is issued until the end of the issuing year and an additional three years further (e.g. date of issue 21 October 2021, valid until 31 December 2024). Other statutory or contractual claims arising from the original ticket remain unaffected.

The Compensation Voucher is transferable to another person. The owner of the Compensation Voucher must not, therefore, be the passenger named on the ticket being bought.  

If the voucher value exceeds the purchase price of the ticket, the remaining value of the voucher can be used for further purchases as part of the validity of the Compensation Voucher. Other statutory or contractual claims from the original ticket remain unaffected for the remaining value of the voucher.

If the amount of the Compensation Voucher is not sufficient for the purchase of a new flight in full, the difference can be credited by credit card (Visa, Mastercard or American Express) during the redemption process.

The SWISS Compensation Voucher can only be used for bookings on www.swiss.com with a route that only includes flights with SWISS flight number (e.g. LX123). 

It cannot be used on tickets already purchased.

By redeeming the Compensation Voucher and purchasing a ticket, a contract of carriage is created between the Compensation Voucher holder and SWISS. The SWISS Terms and Conditions of Carriage apply. These can be found on www.swiss.com.

If tickets paid for with a Compensation Voucher are cancelled in accordance with the statutory or fare conditions and a refund is applied for, the refund value is re-transferred to the Compensation Voucher. 

4. Flight bookings and redeeming Compensation Vouchers

Once the Compensation Voucher is used, its validity expires for the amount used. 

5. Refunds

Compensation Vouchers are non-refundable.

6. Liability

SWISS’s liability to users for compensation is excluded, providing the claim is based on minor negligence. This does not apply if, in breach of an obligation, which the contract must provide for in accordance with its meaning and purpose or fulfilment thereof allows proper execution of the contract and compliance thereof upon which users may generally rely. If SWISS is fundamentally liable, the claim for compensation shall be limited to the typical contractual and foreseeable damages (value of the established service).

The limitations of liability do not apply in the event of injury to life, limb or health, in the case of gross negligence or wilful intent by employees, vicarious agents or legal representatives of SWISS, as well as in the case of legally stipulated liability irrespective of fault or any guarantees undertaken.

7. Availability of the website for the use of Compensation Vouchers

Users are aware that unrestricted availability of the website www.swiss.com is not technically feasible with the relevant services from SWISS. SWISS does not assume any guarantee in this respect. However, SWISS shall endeavour to make www.swiss.com constantly available as far as possible, and at least 90% of the time. In particular, maintenance, security or capacity works on the website and events that lie outside the scope of influence of SWISS (such as disruptions to public communication networks, electricity failures, etc.) may lead to short-term disruptions or the temporary suspension of services. SWISS shall only undertake maintenance, security or capacity works on the website as required and as far as possible at times of low demand. SWISS does not guarantee that third-party services, in particular network services or other services provided by third parties, will always be free from disruption, free from faults or reliably available.

9. Amendments to the terms and conditions of participation

SWISS is entitled to amend these terms and conditions of participation with immediate effect for the future. Users will be informed about this. SWISS shall only have this right if the amendment is reasonable for users in consideration of the interests of SWISS.

10. Final provisions

SWISS law shall apply to these terms and conditions of participation and all legal relationships between users and SWISS; the UN Convention on Contracts for the International Sale of Goods and International Private Law are excluded. In the case of business dealings with consumers within the European Union, the law at the consumer’s place of residence can also apply, providing these concern mandatory provisions of consumer protection law.
